Using these Terms
These Terms apply to Bangs Music Distro (“BMD”, “we”, “us”) at bangsmusicdistro.com and the related services you request. When you create an account, submit content or purchase a service, you agree to the applicable Terms and any clearly disclosed service conditions. If you do not agree, do not create an account, submit content or place an order.
A separate written agreement may set terms for a specific service. These Terms do not replace rights that applicable law does not allow a contract to exclude. Our Privacy Policy explains data handling; reading it does not enrol you in marketing.
Eligibility and authority
You must be at least 18 and able to enter an agreement, or have a parent or legal guardian act for you and accept responsibility. If you act for an artist, label, company or rights owner, you must have authority to give the instructions and permissions involved. We may ask for evidence of authority, identity or rights where relevant. Eligibility or authority may need to be verified for a particular service.
Accounts and security
Provide accurate account and contact details and keep them current. Keep passwords, activation links and verification codes private. Do not sell access, impersonate someone else or use another person’s account without authority. Contact BMD promptly if you suspect misuse.
Account roles control which features are available. A staff invitation, artist account or publisher role does not grant access to unrelated administration or payment functions. Users must not try to bypass access controls.
Services and availability
Services may include music discovery, artist and release pages, playlists, smartlinks, distribution support, downloads, subscriptions and reporting, depending on the current offer and account. Check the relevant service page for what is included before ordering.
External platforms make their own decisions about acceptance, release timing, profile mapping, verification and editorial placement. A purchase does not guarantee streams, chart positions, revenue or approval by another platform. Any recording, publishing, management or rights-administration arrangement must be separately agreed.
Release instructions and metadata
Provide accurate artist names, credits, artwork, release dates, explicit-content labels, ownership information and platform links. UPCs and ISRCs must identify the correct release and recording. Keep the permissions needed for features, beats, samples, cover recordings, artwork and other contributions.
You authorise BMD and the partners used for your requested service to process and deliver the approved material and related metadata. Allow time for review and third-party processing. Corrections, takedowns, migration and artist-profile changes may require further information and cannot be guaranteed to appear immediately on every platform. Avoid conflicting distributor instructions.
Ownership and service permissions
Submitting material does not by itself transfer ownership of your masters, compositions or other copyright to BMD. You must own or control the rights necessary for the requested use, including permissions from collaborators and any relevant rights holders.
You give BMD a non-exclusive permission to store, reproduce, format, display, transmit and deliver your submitted material to provide and promote the service you request. This permission does not replace a separately agreed royalty split. Ending the service may require completion of third-party takedowns; necessary backup, accounting and dispute records may remain, subject to applicable law.
AI-assisted material must meet applicable rights and platform requirements. Do not impersonate a person, use their voice or likeness without required permission, or misrepresent credits and authorship.
Prices, billing and refunds
Prices, included work, limits, renewal conditions and any applicable refund terms are those disclosed with the offer or confirmed in writing when you order. Confirm unclear conditions before paying. Payment may be required before processing starts. A payment reference alone does not establish that a transaction has been verified.
Paystack and other supported payment services apply their own processing and security rules. Work already performed, third-party charges and any lawfully non-refundable costs may affect a cancellation or refund. Contact BMD about failed, duplicate or disputed charges, using the date, amount and transaction reference. Nothing here removes mandatory refund or consumer rights. Do not send card numbers, PINs or one-time codes.
Listening, downloads and premium
Listening and download access depend on what the release and service offer permit. A music purchase provides personal access to the offered download; it does not transfer copyright or grant resale, re-upload, commercial-use or public-performance rights. A free-download option also does not transfer those rights unless a separate licence says so.
Premium benefits follow the offer presented for the subscription. Where BMD offers ad-free access, the benefit concerns BMD-controlled ad placements; independent embedded players and external services can have their own advertising and terms. No access control can guarantee that a file played in a browser cannot be copied.
Reports, royalties and payouts
Play counts, estimated earnings, partner statements and withdrawable balances are different records. A view, play or displayed estimate is not automatically a payable royalty. Amounts depend on eligible activity, verified sales or partner reports, the applicable service agreement and funds received.
Agreed shares, taxes, refunds, chargebacks, currency conversion and partner corrections can affect the final amount. Identity, account or payout-method verification may be needed. Disputed amounts may require review. No fixed earnings, reporting date or payout amount is promised by this page; check the terms of the specific service and ask about unclear deductions or balances.
Honest activity and prohibited use
Do not manipulate plays, clicks, ad impressions, downloads, charts, followers or earnings through bots, account farms, deceptive incentives or other artificial activity. Check the methods used by promoters you hire; buying promotion is not permission to manufacture engagement.
Do not upload malware, phish, spam, submit stolen payment details, misrepresent rights, harass others, publish unlawful content, access private data without permission or bypass account and payment controls. Legitimate copyright, security and payment reviews may affect access to the relevant service or disputed funds.
Rights complaints and account action
Use the Copyright page to identify allegedly infringing material and explain your authority. A complaint is a request for review, not proof of infringement. BMD may request evidence, restrict disputed material, notify affected parties or take account action where reasonably necessary. Serious or repeated infringement, fraud or security abuse may lead to suspension or closure, subject to applicable law.
You may request account closure or eligible content removal. Closure does not automatically erase payment, royalty, dispute or other records that must be retained. Contact support if you believe a restriction or removal was mistaken; formal counter-notice procedures apply only where legally applicable.
External services and service limits
Music platforms, payment processors, email providers, analytics services and linked websites operate independently and apply their own terms and policies. Their availability and decisions can affect a requested service.
BMD aims to provide its services with reasonable care, but uninterrupted availability, perfect reporting and complete protection from every security threat cannot be guaranteed. Rights and liabilities are subject to applicable law and any valid service agreement. This page does not exclude liability or consumer protections that cannot lawfully be excluded.
Privacy and communications
The Privacy Policy describes account, usage, payment, support and legal-request information. Service and security notices differ from optional marketing. Keep your registered contact information current. You can submit a privacy or direct-marketing objection through the privacy request form. Necessary verification may be required before information is disclosed or an account is changed.
Changes, applicable law and contact
The version date identifies this document’s revision, not a retrospective change to a completed purchase or separate agreement. Material changes are subject to any notice or acceptance required by applicable law.
These Terms are governed by Ghanaian law, while preserving mandatory rights that otherwise apply. Disputes may be brought before a competent court; contacting BMD first can help resolve a service issue but does not remove a legal right to seek a remedy.
